The deputies from the Nassau County Sheriff's Office responded, as deputies do on any alarm call. What they did next is the part that cannot be undone: they entered the home's fenced backyard with their weapons already drawn. Posted at the property were "Beware of Dog" signs — notice, in writing, that a dog lived there and might come to meet anyone who walked in.
The dog was Lola. Her breed was never reported; what her family reported instead was her history — she had never bitten anyone. When she approached the armed strangers standing inside her fence, her owners said, she was likely coming up to be friendly.
The deputy fired three times. Lola died in her own backyard, during a police response to a burglary that never happened.
The dispute here is narrow, because so much is undisputed. No one contests that the alarm was false, that the yard was fenced, that the signs were posted, that the deputies entered with guns out, or that the deputy fired the three shots that killed her. The only contested ground is Lola's intent — and Lola cannot testify. Her owners say a dog with no history of biting was approaching in friendliness.
